Why do Real-Estate Brokers Send a Disclaimer Before They Send a Report
Since June 13th, 2014 brokers are bound to send a revocation instruction before they send a real-estate report. According sec. 355 German Civil Code (BGB), real-estate brokers are obliged to inform their customers on their 14-day right of revocation in online transactions. If this information is given at a later date, also the period begins later and the brokers activity is not covered.
With enquiry on a certain object at the estate agent and the provided revocation instruction and the properties´ report before sighting of the object, the brokerage-agreement already enters into force. Within 14 days after conclusion, customers can make use of their right of revocation from the brokerage-agreement in writing and without further explanation.
Within the right of revocation, viewing appointments can only be agreed upon under waiver of right of revocation.
In any event: Commission costs can only emerge in a successful brokerage and a concluded purchase agreement.
